Stop wage garnishment, foreclosure and creditor calls

The automatic stay goes into effect the day your case is filed, and generally stops garnishments, foreclosure sales, lawsuits and collection calls.

When collection pressure becomes urgent

A wage garnishment notice, foreclosure sale date or collection lawsuit is a reason to call Jeff promptly. Explain what the document says and the date involved. The Schreiber Law Firm reviews urgent bankruptcy matters and can discuss whether emergency preparation is possible in your circumstances. A consultation request is not a filing and does not itself stop collection.

It is useful to separate the immediate deadline from the larger debt problem. You may need an urgent review of a creditor's next step, while also needing to understand which bankruptcy chapter fits your income, property and other obligations.

What the automatic stay generally does

When a bankruptcy case is filed, the automatic stay generally requires most creditors to stop collection activity. That can affect wage garnishments, a pending foreclosure sale, many collection lawsuits and creditor calls. The protection has exceptions and limits; Jeff reviews what it means for the particular action you are facing.

The stay does not cover everything. Certain matters, including child support collection and some criminal proceedings, are outside its general protection. Previous filings and the circumstances of a case can also matter. Do not rely on a general website description to decide whether a particular creditor must stop. Ask Jeff about the notice or action itself.

Wage garnishment and creditor lawsuits

If money is being taken from your paycheck, mention the garnishment when you first call. Identify the creditor, the notice and any dates you know. If you have lawsuit papers, identify the case and any upcoming deadline rather than assuming a bankruptcy inquiry replaces a response in that matter.

The review should also address the obligation behind the collection action. Stopping immediate pressure and dealing with the underlying debt are connected but distinct questions. Chapter 7 and Chapter 13 handle debt differently, so the recommendation depends on more than the fact that a creditor is collecting.

A pending foreclosure needs a timing discussion

If your home is scheduled for a sale, tell Jeff the date as soon as you call. Filing generally affects a pending foreclosure through the stay, subject to the limits that apply in the case. Chapter 13 may offer a repayment approach for catching up on past-due mortgage payments, but the plan must be reviewed against your income and expenses.

The immediate question is what can be done before the deadline. The longer-term question is whether the proposed route works for your finances. Neither protection nor a successful repayment plan can be promised from an online form. The firm's home and car guide gives background for the property discussion.

Call and explain what is happening

Call 619-933-6057 for a free consultation. Jeff can usually prepare an emergency petition within hours when the situation allows, but the available records and circumstances need review. Discuss fees, the documents needed and the next step directly with him.

Consultations can be by phone, video or in person at the La Jolla or El Cajon office. Preparation uses electronic document uploads and an in-person review and signing meeting. Do not send confidential notices through the public form. Contacting the firm does not create an attorney-client relationship or guarantee that a creditor's action will stop.

When I called, he is the one that answered, and was very fatherly and supportive of our situation and the fears we had about our future. He helped me feel less ashamed and explained how everything would work... Overall, if your finances are keeping you up at night, and you want as little meetings as possible and things to be handled more remotely, and don't want a large lawyer company, he is your guy. Life is much better for us now.

Sharon H.Client testimonial

He spent over an hour on the phone with us. There was no pressure, just kindness. He was patient and reassuring. He was organized. The day of the hearing, we sat in the lobby awaiting our hearing and four other lawyers walked in (representing multiple clients each) looking frazzled and crazed. Jeffrey Schreiber was representing us, and only us. He was ready, on-time, presentable and calm which in turn, calmed us.

Phil G.Client testimonial

He gave me excellent advice and fully prepared me for everything that was going to happen. He made me feel very comfortable with my situation. Mr. Schreiber is extremely knowledgeable in handling cases like mine. Everything that he said he was going to do he did. His level of professionalism and vast knowledge has been impeccable, imperative and more than appreciated.

Cynthia L.Client testimonial

I am in awe of his talents, vast knowledge and expertise. I was surprised by his compassion, impressed with his expertise - pleased that he was giving me possible alternatives to filing, all conveyed in a very relaxed, no pressure, phone conversation. I did seek some second opinions and very quickly realized how inept these other attorneys were. Mr. Schreiber proved to be head and shoulders above all the rest.
